CareForge AI Terms of Service

1. Introduction

CareForge AI, LLC (the "Company"), a Virginia-based entity, operates the CareForge platform (the "Service"), which provides non-clinical digital tools to support the mental wellness of veterans and first responders. These Terms of Service ("Terms") govern your use of the Service. By accessing or using CareForge, you agree to be legally bound by these Terms. If you do not agree, do not use the Service.

The Effective Date of these Terms is listed at the top of this document. Material updates to the Terms will be communicated via in-app notices or email. Continued use of the Service following such updates constitutes acceptance of the revised Terms.

2. Eligibility

You may only use CareForge if you meet the following conditions:

Minimum Age: You must be at least 18 years old. Use by anyone under 18 is strictly prohibited. We do not knowingly collect data from minors.

Emergency Exclusion: CareForge is not an emergency or crisis intervention tool. If you are experiencing a medical or psychiatric emergency, call 911 or contact emergency services in your location. Do not rely on the Service for immediate help.

Jurisdictional Use: The Service is currently offered for use within the United States only. It is not available in jurisdictions with additional compliance requirements such as the EU/UK (under GDPR). We will notify users if and when availability expands. The Service is not a HIPAA-covered entity at this time, but we apply privacy practices consistent with HIPAA principles. Should the platform later qualify as a covered entity (e.g., through clinician data sharing), updated policies and required authorizations will be issued.

3. Nature of the Service

CareForge is not a licensed healthcare provider. It is a digital support tool that uses AI to offer:

  • •Mood tracking
  • •Emotional pattern recognition
  • •Non-clinical summaries

The Service does not provide diagnosis, treatment, or clinical advice. All outputs are for informational and supportive purposes only. You must not interpret any AI-generated content as professional medical or psychological guidance. You should not delay, modify, or avoid seeking professional care based on anything presented in the Service.

Outcomes will vary. We make no guarantees that use of the Service will improve any health condition. The Service is provided strictly "as is."

4. User Responsibilities

By using the Service, you agree to the following terms regarding acceptable use, user conduct, system limitations, and your obligations:

4.1 Lawful and Intended Use

You will use the Service solely for personal, lawful, and non-commercial purposes as intended by CareForge.

You may not use the Service:

  • •In any way that violates applicable law or regulation
  • •For clinical diagnosis, emergency response, or as a substitute for professional mental health or medical advice
  • •To operate or manage life-critical or safety-critical systems

4.2 Conduct and Content

You are responsible for all content you submit through the Service.

You will not submit, upload, or share content that:

  • •Is unlawful, defamatory, harassing, threatening, or invasive of another's privacy
  • •Promotes violence, discrimination, or self-harm
  • •Infringes upon intellectual property or privacy rights of others
  • •Includes personal or sensitive information about others without their explicit consent

4.3 Misuse of AI

You agree not to:

  • •Prompt or instruct the AI to produce content that is violent, exploitative, deceptive, sexually explicit, or otherwise harmful
  • •Attempt to override, disable, or bypass any moderation, safety, or filtering systems
  • •Rely on AI-generated outputs for critical decisions without consulting qualified professionals

AI outputs are probabilistic, may lack context, and can contain inaccuracies or unintended bias. The Service makes no guarantee as to the accuracy, completeness, or appropriateness of any AI response.

4.4 System Integrity

You agree not to:

  • •Probe, scan, or exploit the Service or related systems
  • •Reverse engineer, decompile, or create derivative works based on the Service
  • •Interfere with or disrupt the platform, servers, networks, or infrastructure
  • •Use any automated tools (including bots, scrapers, or scripts) to interact with the Service without prior written consent

4.5 Account Security

You are responsible for maintaining the confidentiality and security of your login credentials and account access.

You must notify CareForge immediately of any unauthorized use or suspected security breach.

You are fully responsible for all activity under your account.

4.6 Crisis and Emergency Situations

The Service is not designed for use in crisis, emergency, or life-threatening situations.

You acknowledge and agree:

  • •The AI does not provide real-time monitoring, clinical intervention, or emergency services
  • •If you are experiencing thoughts of self-harm, harm to others, or any mental health crisis, you must immediately contact a qualified professional or emergency service (e.g., 911, 988 Suicide & Crisis Lifeline)
  • •Submitting crisis-related content through the platform does not notify CareForge or connect you to emergency responders
  • •Attempting to rely on the Service for crisis management constitutes misuse and may result in termination of access

4.7 Consequences of Breach

Violations may result in immediate suspension or permanent termination of your account without notice.

CareForge reserves the right to investigate suspected violations and cooperate with law enforcement or regulatory authorities as required.

5. User Content

You retain ownership of all content you submit (e.g., journal entries, mood logs, chat inputs). By using the Service, you grant CareForge a limited, non-exclusive, royalty-free, worldwide license to use your content to provide and improve the Service. This includes internal analysis, feature development, and AI model refinement.

All analysis is performed using anonymized and/or de-identified data where possible, consistent with industry best practices and applicable privacy laws. Identifiable data will not be used for public disclosure without your explicit consent.

AI-generated summaries or insights are based on your input and may not be accurate or clinically validated. Do not rely on them for medical decision-making.

6. AI and Limitations

The AI features are automated and non-sentient. They may produce incorrect, misleading, or inappropriate responses due to algorithmic limitations. CareForge does not guarantee:

  • •Accuracy or relevance of responses
  • •Emotional appropriateness
  • •Suitability for your personal circumstances

CareForge is not responsible for any decisions, actions, or outcomes based on AI-generated responses.

The Service is designed for non-clinical support. We include persistent links to external crisis hotlines, but we cannot guarantee their accuracy, uptime, or effectiveness. You are solely responsible for seeking professional or emergency care when needed.

7. Optional Clinician Integration

Users may choose to connect their CareForge account with an external licensed clinician. This feature is optional and initiated by the user. If you opt in, you authorize sharing your data with the selected clinician.

Key conditions:

  • •Clinicians are independent third parties, not employees or agents of CareForge.
  • •CareForge is not responsible for any advice, conduct, or outcomes associated with any clinician.
  • •Your interactions with clinicians are governed by their own professional and legal obligations.
  • •CareForge disclaims all liability arising from any third-party medical services, including any reliance placed on summaries shared through the platform.

8. Account & Termination

You may terminate your account at any time by using in-app settings or contacting support. Upon termination:

  • •We will deactivate your account promptly.
  • •Data will be deleted or anonymized, except for limited retention required for legal, audit, or backup purposes.
  • •Examples of retained data include system logs and legal records, retained in accordance with applicable law.

CareForge may suspend or terminate your account immediately, without notice, for violation of these Terms, misuse, or behavior that presents legal or reputational risk.

9. Intellectual Property

Except for your User Content, all intellectual property in the Service—including code, design, trademarks, branding, and content—is owned by CareForge AI, LLC or its licensors. You may not:

  • •Copy, distribute, or create derivative works
  • •Reverse-engineer or attempt to extract source code
  • •Use CareForge branding or likeness without permission

This includes but is not limited to logos, app design, interface elements, and written materials.

10. Force Majeure

CareForge AI, LLC shall not be held liable for any delay or failure to perform any obligation under these Terms if such delay or failure results from causes beyond its reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, governmental action or regulation, labor disputes, supply chain disruptions, utility failures, internet or telecommunications outages, cyberattacks, or infrastructure failures.

Such events shall not constitute a breach of these Terms, and the time for performance shall be extended for the duration of the force majeure event. CareForge will make reasonable efforts to mitigate the effects of any such disruption and to resume operations as quickly as feasible.

11. Disclaimers & Limitations of Liability

The Service is provided "as is" and "as available," without warranties of any kind. CareForge disclaims all express or implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law:

  • •CareForge is not liable for any indirect, incidental, special, consequential, or punitive damages.
  • •We are not responsible for emotional distress, personal decisions, data loss, or third-party content.
  • •We are not responsible for any service interruptions, system failures, or issues related to our third-party providers (e.g., cloud vendors or AI infrastructure).
  • •Our maximum liability is limited to the greater of $100 or the total amount you paid to CareForge in the 12 months before the claim arose.

12. Indemnity

You agree to indemnify, defend, and hold harmless CareForge AI, LLC and its officers, directors, employees, contractors, and agents from any claims, damages, losses, costs, or liabilities (including attorneys' fees) arising from:

  • •Your use or misuse of the Service
  • •Your violation of these Terms
  • •Any content you submit or share
  • •Your violation of any law or third-party rights

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law rules.

Arbitration: You agree that any dispute, claim, or controversy with CareForge will be resolved by binding individual arbitration, not in court, to the maximum extent allowed by law.

  • •No class actions or representative proceedings are permitted.
  • •Each party waives any right to a jury trial.
  • •Some claims (e.g., small claims) may be resolved in local court as allowed.
  • •This clause is subject to limitations imposed by applicable consumer protection laws.
